Art. 1 Scope of application

1.2 This document(Terms of Use) governs the terms of use of this Site by the user, i.e. the natural person interacting with the Site(User).

Art. 2 Intellectual Property

2.1 Any material on the Site is copyrighted under Law 633/1941. Therefore, unless otherwise agreed in writing with the Site Owner or unless otherwise indicated on the Site, the User is prohibited from copying, disseminating, communicating, assigning, modifying, in whole or in part, for any reason and in any form, the material on the Site. The prohibition of reproduction also extends to the Site’s layout, graphics, design, and mode of presentation of web pages.

2.2 The User is prohibited from using domain names that are similar to those of the Site or that may cause confusion among users.

2.3 The prohibition in Article 2.1 refers specifically to:

– Photographs and articles;

– eBooks or any other downloadable materials.

2.4 The trademarks and distinctive signs on the Site are the property of the Site Owner or third parties. Therefore, the User is prohibited from using, reproducing, modifying, in any way and for any purpose (including non-economic), these trademarks and distinctive signs, except with the written consent of the Site Owner or the third party owner of the trademark or distinctive sign.

Art. 3 Use of the Site and User Responsibility.

3.1 The User may interact with the Site and its functions only for lawful purposes, without causing harm to the Site Owner or third parties.

3.2 The User is personally responsible for the use of the Site, as well as for any information, messages or documents transmitted to the Site Owner or third parties through the Site.

3.3 The User is prohibited from circumventing, in any way, any form of protection of the Site.

3.4 The Site Owner reserves the right to suspend (including indefinitely) or terminate your account if it believes that you have used the Site in violation of the regulations applicable from time to time or have caused or attempted to cause harm to the Site Owner or any third party.

3.5 There is no discussion forum on the Site. Therefore, a user who wishes to share material may send it to the Site Owner. The Site Owner reserves the right to publish material on the Site and/or share it with any third party. The User waives any rights and/or claims to the material submitted to the Site Owner.

3.6 There are links to external sites on the Site. The Site Owner is not responsible for the content of these sites and for any damage or harm that the User may have suffered from interaction with them.

Article 4 Exclusion of Liability of the Site Owner

4.1 The Site Owner disclaims any liability for any damage resulting from inaccessibility to the Site, even temporary, and for damage caused by viruses, incorrect/missing information or data, deletion of content, any network problems or attributable to the network provider. The Site Owner disclaims any liability for any damage or harm that the User may have suffered from any material downloaded through the Site.

4.2 The Site Owner has taken every standard precaution to post truthful information on the Site. That being said, the Site Owner makes no warranty as to the accuracy of this information. The User is encouraged to notify the Site Owner of any incorrect or missing information.

Art. 5 Processing of personal data. Cookie Management

5.1 Any personal information of the User is processed in accordance with Regulation 679/2016 (GDPR) and the guidance of the Privacy Guarantor.

5.2 The user can view how personal data are processed by accessing the privacy policy posted on the Site.

5.3 How cookies are handled can be viewed by accessing the cookie policy posted on the Site.

Article 6 Applicable Law. Jurisdiction

6.1 The law applicable to these Terms of Use is Italian law.

6.2 Any dispute arising from the application and/or interpretation of these Terms of Use shall be subject to the exclusive jurisdiction of the Court where the Site Owner is located. If the User acts as a consumer under Art. 3 of the Consumer Code, the competent Photo is the one where the User has residence or domicile.
